Terms of Service

Welcome to MobAI Inc. ("MobAI," "we," "us," or "our"). These Terms of Service govern your access to and use of the MoonShort platform, the MobAI website, account services, APIs, and related services. By accessing or using the services, you agree to these Terms. If you do not agree, do not use the services.

1. Eligibility

You must be at least 13 years of age, or the minimum age required in your jurisdiction, to use the services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

Some features require an account. You agree to provide accurate information and to keep it current. You are responsible for safeguarding your account and for all activity under it. You must notify us promptly of unauthorized use.

3. Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the services for personal, non-commercial purposes. You agree not to:

• Use the services for unlawful purposes or in violation of applicable laws.
• Reverse engineer, decompile, or attempt to derive source code from any part of the services.
• Use bots, scrapers, crawlers, or automated access without prior written consent.
• Interfere with the integrity, security, or performance of the services.
• Attempt unauthorized access to accounts, systems, or networks.
• Upload or distribute harmful code.
• Harass, abuse, threaten, or intimidate other users.
• Generate or distribute illegal, defamatory, obscene, or otherwise objectionable content.

4. User Content

The services may allow you to create, submit, post, or share story branches, remix forks, character configurations, screenshots, chat messages, and other content. You retain ownership of your content, but grant MobAI a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display it in connection with operating and improving the services.

You represent that you own or have the necessary rights to submit your content and that it does not infringe third-party rights. We may review, monitor, or remove content at our discretion.

5. Intellectual Property

All rights in the services, including software, algorithms, AI models, designs, trademarks, logos, storylines, game mechanics, and other intellectual property, remain the property of MobAI and its licensors. The MobAI and MoonShort names and associated marks may not be used without prior written permission.

6. Virtual Items and Purchases

The services may offer virtual currency, items, or digital goods. Virtual Items have no real-world monetary value and cannot be exchanged for cash. Purchases are final and non-refundable except as required by law.

7. AI-Generated Content

Some content may be generated in whole or in part by AI systems. AI-generated content may contain errors or unexpected outputs. You use such content at your own discretion and risk.

8. Third-Party Services

The services may link to third-party websites, identity providers, or services. We do not control or endorse third-party content, privacy practices, or terms. Your interactions with third parties are solely between you and them.

9. Privacy

Your use of the services is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBAI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MOBAI IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $100.

12. Indemnification

You agree to indemnify and hold harmless MobAI, its directors, officers, employees, agents, and affiliates from claims arising out of your use of the services, your content, your violation of these Terms, or your violation of third-party rights.

13. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Provisions that by nature should survive termination will survive.

14. Modifications

We may update these Terms by posting the revised Terms and updating the effective date. Continued use after the effective date means you accept the revised Terms.

15. Governing Law

These Terms are governed by Delaware law, without regard to conflict-of-law principles. Disputes will be resolved exclusively in state or federal courts located in Delaware.
